Supreme Court Takes Up DOMA: The 3 Possible Outcomes | TPMDC

In a major case next spring, the Supreme Court will consider whether it?s constitutional for the federal government to refuse to recognize same sex marriage, as multiple lower courts have decreed.

The justices have several options on how to come down in the Windsor v. United States challenge to Section 3 of the 1996 Defense of Marriage Act, which denies federal benefits to gay couples that are legally married in their states.

Earlier this week TPM gamed out the potential outcomes on Proposition 8, the other big same sex marriage case the Court decided to hear regarding whether states like California can outlaw gay marriage.

Here?s how legal experts say they might rule in the unrelated DOMA case, which deals with federal law.

1) Strike Down DOMA

The Court could determine that Section 3 of the Defense of Marriage Act violates the Constitution?s guarantee of equal protection for all under the law. In that scenario, gay couples in states like Massachusetts and Maine would begin to receive federal perks for married couples such as retirement and tax benefits.

The reach of such a decision would be important for future gay marriage battles.

?Of course, if they strike it down they could write the opinion narrowly, just about Section 3 of DOMA, or broadly in a way that recognizes a constitutional right to marriage equality,? says Erwin Chemerinsky, a constitutional law professor at UC-Irvine.

2) Uphold DOMA

The majority of justices could find Section 3 of DOMA valid under the Constitution. That would enshrine a status quo where gay married couples in states where same sex marriage is legal are treated differently than their straight counterparts under federal law.

Along with being denied tax and Social Security survivor benefits, gays would continue to not have the ability to sponsor foreign spouses for legal immigration status, as straight married couples are permitted to do.

3) Punt

The Supreme Court could potentially dismiss the case on procedural grounds. The case is unusual in that the Obama administration ? the designated defendant for a federal law ? has refused to vouch for DOMA. House Republicans retained counsel to defend the law. The justices may decide that the case was not properly defended and remand it to the lower courts to try again.

?One possibility is that the Court avoids the DOMA question entirely,? said Adam Winkler, a law professor at UCLA. ?The Court could say that the House committee that?s defending DOMA is not a proper party to the case. Because the Obama administration has refused to defend DOMA, this would mean that the case would be sent back to the lower courts.?

Eventually, however, the case is likely to find its way back to the Supreme Court.

Morgan Stanley Fined $5M Over Facebook Research And Handling Of IPO By Massachusetts

This is the second huge fine for Morgan Stanley, the first being over “noncompetitive trades” in June. Facebook’s stock jumped out of the gates and dipped dramatically, and Morgan Stanley filed a report based on its research afterwards, including why it was priced at $38: Our base case scenario assumes that Facebook?s revenue growth moderates as it takes a measured approach to increasing mobile ad load while engagement increasingly shifts to mobile devices. Facebook enters an investment cycle characterized by compressed adjusted operating margins in C2012/13E. Facebook grows total revenue at a +28% CAGR from C2013-16E, while advertising revenue (+31%) grows substantially faster than payments revenue (+17%) due to casual games being played increasingly through mobile devices. We forecast C2013E adjusted EBITDA margin of 60% in this scenario. The state of Massachusetts also fined Citigroup $2M for its involvement in the Facebook IPO. At the time, it was said to be over “violating state securities law when it released confidential information about Facebook Inc.” When the fine was levied, Citgroup’s Sophia Stewart had this to say: We are pleased to have this matter resolved. We take our internal policies and procedures very seriously and have taken the appropriate actions. We have reached out to Morgan Stanley for comment. There has been discussion about Facebook’s eventual $5B IPO for some time, and after the fact, people have been saying that something wasn’t quite on the up and up. For a company that makes $25B in revenue yearly, the $5M fine could be a drop in the bucket financially, but a huge ugly mark on the company’s reputation. The company did make out quite nicely on the Facebook IPO, even though others did not. Facebook’s stock currently sits at $26.60 a share, nearly $12 below its initial offering price. Endangered Tadpoles' Mission: Help Restore Toad Species

Thousands of tadpoles are on a journey from Cleveland to Puerto Rico as part of an effort to save their critically endangered species.

The traveling tadpoles are Puerto Rican crested toads, and the Cleveland Metroparks Zoo is part of the Species Survival Plan that works to breed the toads and release them back to the wild. The plan is managed by the Association of Zoos & Aquariums.

"The Puerto Rican crested toad Species Survival Plan has been very successful," said Lynn Koscielny, the associate curator of animals at the zoo. "Field researchers in Puerto Rico have observed toads with transponders that were released into the wild returning to the protected ponds to reproduce."

The Puerto Rican crested toad is the only native toad on the island and it is threatened by habitat loss and competition from alien invasive species that have been introduced to the island, such as the cane toad.

The zoo already sent a group of toads to Puerto Rico in 2010, according to a zoo release, but the current group of 4,500 tadpoles is much larger.

The tadpoles will be sent to the U.S. Fish and Wildlife Service's Caribbean Refuge in San Juan and then taken to one of three potential release sites along the southern coast of Puerto Rico, which is an unincorporated territory of the United States.

The zoo has to breed the toads under conditions that mimic those they would have in their native environment.

"This involves cooling the toads down to 66 degrees [Fahrenheit (19 degrees Celsius] and then placing them in a rain chamber tank that simulates the rainy season in the toads' native Puerto Rico," the release said. "A sound recording of the male crested toad?s mating call adds to the simulated environment."

No Need to Overexercise - Eating Disorders Blogs

Recently I came across an article on exercise which will help set you straight if you believe you must live at the gym or run marathons to lose weight. Rather than pushing a weight loss focus here, I?m sharing some enlightening and surprising research on exercise and shedding pounds. I?m a firm believer that the primary purpose for activity and exercise should be fitness, good health, and enjoying body movement.

?Less exercise may do more to shed pounds? by Gretchen Reynolds (NY Times, 9/25/12) offers an unexpected take on exercise. Researchers at the University of Copenhagen in Denmark ?found that exercise does seem to contribute to waist-tightening, provided that the amount of exercise is neither too little nor, more strikingly, too much.? For the study, participants, all male, were discouraged from consciously changing their diets and divided into one control group which didn?t exercise, one which did moderate workouts, and another which engaged in a strenuous exercise routine.

At the end of the 13-week study, there was no difference in the weight of the control group. The surprise outcome was that the men in the strenuous exercise group lost less weight than the ones in the moderate exercise group. Why? Researchers surmise that the difference was due to the fact that the strenuous exercisers consumed more calories than the moderate exercisers and that the strenuous exercises were so fatigued after going through their routines that they then remained relatively inactive the rest of the time. Moreover, the moderate exercisers ?seemed to grow more energized and inspired? to do activities such as ?taking the stairs? and ?just moving around more.?

This is fabulous news for those of you who wish to exercise but can?t make it your life?s work. Although many disregulated eaters have difficulty engaging in routine activity, others switch their ?addiction? from eating to workouts believing, as with food, that more is better. Moreover, many disregulated eaters who wish to become healthier assume that if they can?t do a lot of exercise, it?s not worth doing any and, therefore, don?t bother. Each end of the spectrum highlights all-or-nothing thinking, a hallmark of disregulated eaters, which misses the middle ground of activity which would benefit them the most.

Whether you?re an over-exerciser replacing food with activity as a coping mechanism or an under-exerciser who ends up doing nothing because you can?t do it all, this article?s conclusions should set you straight and give you hope. Take time to consider how much exercise would be enough?just right?for you. Think mid-range, not maximum, and you?ll have a better shot at carrying your exercise plans to fruition.

Hope and fear in gay marriage cases at high court

WASHINGTON (AP) ? Gay marriage supporters see 41 reasons to fret over the Supreme Court's decision to take up the case of California's ban on same-sex unions.

While nine states allow same-sex partners to marry, or will soon, 41 states do not. Of those, 30 have written gay marriage bans into their state constitutions.

That fact is worrisome to those who firmly believe there is a constitutional right to marry, regardless of sexual orientation, but who also know that the Supreme Court does not often get too far ahead of the country on hot-button social issues.

"Mindful of history, I can't help but be concerned," said Mary Bonauto, director of the Civil Rights Project at Gay and Lesbian Advocates and Defenders and a leader in the state-by-state push for marriage equality.

Bonauto was speaking before the court decided on Friday to take up cases on California's constitutional ban on gay marriage and a federal law that denies to gay Americans who are legally married the favorable tax treatment and a range of health and pension benefits otherwise available to married couples.

In 2008, California voters approved the ban, Proposition 8, after the state Supreme Court ruled that gay Californians could marry. Since then, a federal appeals court struck down the constitutional provision, but did not authorize the resumption of same-sex marriages pending appeal.

Bonauto identified three earlier seminal rulings that once and for all outlawed state-backed discrimination, and observed that in each case the number of states that still had the discrimination on the books was far smaller.

Thirteen states still had laws against sodomy when the court said in 2003 that states have no right to intrude on the private, personal conduct of people, regardless of sexual orientation.

Interracial marriage still was illegal in 16 states in 1967 before the high court outlawed race-based state marriage bans.

In 1954, when the court issued its landmark decision in Brown v. Board of Education, 17 states had formally segregated school systems.

Cornell University law professor Michael Dorf said those cases illustrate a widespread misperception about the justices.

"There is a commonly held but inaccurate view that the Supreme Court does is to impose its views on the country. It very rarely does that. Much more frequently, it will take a view that is either a majority in some place or a majority of elite opinion, and speed up acceptance," said Dorf, who was a Supreme Court law clerk to Justice Anthony Kennedy.

The forces that mounted the legal challenge to Proposition 8 have said all along that the right to marry is so fundamental that it should not depend on success at the ballot box or the votes of state legislatures. Washington lawyer Theodore Olson, representing gay Californians who wish to marry, said he will argue that there is a "fundamental constitutional right to marry for all citizens."

But are there five justices, a majority of the court, willing to endorse that argument?

The fear among gay marriage proponents is that the court will refuse to declare that states can no longer define marriage as the union of a man and a woman, because to do so might provoke a backlash in public opinion and undermine acceptance of its authority.

A high court loss for gay marriage advocates would prevent same-sex marriages in the nation's largest state. It would not affect the District of Columbia and the nine states ? Connecticut, Iowa, Maine, Maryland, Massachusetts, New Hampshire, New York, Vermont and Washington ? where gay couples can or soon will be able to marry.

But it could push back the day that many in the gay rights movement, looking at strong support for gay marriage among younger Americans, see as inevitable: the Supreme Court's endorsement of full marriage equality nationwide.

Commenting after the court's action, Bonauto said she believes the court can uphold an appeals court ruling that struck down Proposition 8 in a way that applies to California only and "leave to a later day questions about broader bans on committed same-sex couples marrying."

Opponents of gay marriage look to another court case, Roe v. Wade, that they say should serve as a cautionary tale. In 1973, the court voted 7-2 to declare that the Constitution protects a woman's right to an abortion.

"Should the Supreme Court decide to overturn the marriage laws of 41 states, the ruling would become even more divisive than the court's infamous Roe v. Wade decision," said Tony Perkins, president of the Family Research Council. "Marriage, unlike abortion laws in the 1970s, has been incorporated into the state constitutions of 30 states. Voters in these states will not accept an activist court redefining our most fundamental social institution."

To a degree, Perkins and Bonauto get some support from one of the nine people with a say in the matter, Justice Ruth Bader Ginsburg.

In February, Ginsburg questioned the timing of the abortion decision and suggested it may have contributed to the ongoing bitter debate about abortion.

"It's not that the judgment was wrong, but it moved too far too fast," Ginsburg said at Columbia University.

At the time of Roe v. Wade, abortion was legal on request in four states, allowed under limited circumstances in about 16 others, and outlawed under nearly all circumstances in the other states, including Texas, where the Roe case originated.

The court could have put off dealing with abortion while the state-by-state process evolved, she said. Or her predecessors could have struck down just the Texas law, which allowed abortions only to save a mother's life, without declaring a right to privacy that legalized the procedure nationwide, Ginsburg said.

"The court made a decision that made every abortion law in the country invalid, even the most liberal," Ginsburg said. "We'll never know whether I'm right or wrong ... things might have turned out differently if the court had been more restrained."

New Mayor?s Commission on Unity, Diversity, & Prosperity holds first meeting

COLUMBUS, GA (WTVM) -

It's been more than 10 years since "One Columbus" was created. On Thursday, it was dissolved and merged into a new city commission.

Two dozen members of the now-Mayor's Commission for Unity, Diversity and Prosperity met Thursday morning at the government center. The MLK Jr. Steering Committee will also be part of this new group. Leaders say the renewed mission will be looking at diversity through the prism of poverty...a think tank tackling issues like income disparity and housing.

"These are systemic issues, this is not a 2-year journey, this is a multiple year journey," said new commission chair Jane Nichols, Goodwill CEO.

"Residents living in poverty, with these types of challenges, it affects your business...your workforce...your crime rate...your education," said Columbus Mayor Teresa Tomlinson. ?

"What this committee will do is make sure we have innovative ideas and strategies that possibly have not been used before," said Rev. Johhny H. Flakes III, pastor of 4th St. Missionary Baptist Church. ?

"Bring to light some of our community needs and try to find ways to solve those issues and make for a much more equal and vibrant community," said Terri Parodi, volunteer director for United Way. ?

We will continue partnering with this group for our annual diversity forum, which will be live on WTVM on January 24 from the Rivercenter in downtown Columbus. The one-hour special will be at 8 p.m. on that Thursday night.

Icahn gives up bid for truck maker Oshkosh

(AP) ? Billionaire investor Carl Icahn is giving up his bid to buy truck maker Oshkosh after less than 25 percent of the company's shares were tendered before his offer expired.

Last week Icahn made it clear that he would walk away from his bid if the threshold wasn't met. The tender offer expired on Monday, with about 22 percent of the shares tendered.

Icahn, who is known for buying stakes in struggling companies and then shaking them up with mixed results, had previously maintained that Oshkosh Corp. needs new management and a new strategy.

But he had said that he would "move on to other endeavors" if he did not get at least 25 percent of Oshkosh's shares in the tender offer.

Oshkosh's stock fell 2.8 percent in premarket trading Tuesday.
